Although Confucianism is a resilient cultural tradition in Asian societies, its role in their corporate governance systems is ambiguous. Confucian values have been pushed to the periphery because of a preoccupation in these countries to emulate corporate governance systems from the West. This article argues that Confucianism has much to offer in enhancing director conduct and corporate governance standards. As the attention of the global business community turns eastwards, it is opportune to revive interest in Confucianism and to explore ways (...) in which it can be integrated formally into companies' governance systems. The recent Minnesota case of In re Emergency Guardianship of Albert Barnes illustrates an emerging class of cases where a dispute between a family proxy and a hospital over “medical futility” requires legal resolution. The case was further complicated by the patient’s spouse who fraudulently claimed to be the patient’s designated health care proxy and who misrepresented the patient’s previously expressed treatment preferences. Barnes demonstrates the degree of significant administrative and institutional support to the health care team, ethics consultants, and (...) futility committees that is required when a futility dispute escalates to the need for judicial resolution. An institutional futility policy, especially one that is endorsed by other regional medical centers and organizations, is an important foundation for a hospital that seeks judicial support in a dispute over medical futility in end of life care. Futility disputes are increasing and courts are slowly abandoning their historical reluctance to engage these contentious issues, particularly when confronted with inappropriate surrogate demands for aggressive treatment. Use of the judicial system to resolve futility disputes inevitably brings media attention and requires clinicians, hospitals, and families to debate these deep moral conflicts in the public eye. A recent case in Minnesota, In re Emergency Guardianship of Albert Barnes, explores this emerging trend and the complex responsibilities of clinicians and hospital administrators (...) seeking to replace an unfaithful surrogate demanding aggressive therapy. Use of the courts requires the coordinated commitment of significant institutional resources, management of intense media scrutiny and individual and organizational courage to enter the unpredictable world of litigation. Given the dearth of legislative guidance on medical futility, individual clinicians and institutions will continue to bear the difficult responsibility for resolution of individual futility disputes. The Barnes case illustrates how one institution successfully used the judicial system to replace an unfaithful surrogate, cease the provision of inappropriate aggressive care, and stimulate a community dialogue about appropriate care at the end of life. The paper applies to approval voting, under which the voter casts a ballot by casting one vote for each of k candidates, wherek=;1,2, ? , m-1 and there are m candidates. I assume (following Brams and Fishburn) that each of the voter's 2=;-2 strategies is equally likely to be chosen. Election-outcome types include: the m-way tie;(m-1) -way ties with the runner-up trailing by 1,2,?,m votes; (m-2)-way ties, and so on. The frequency distribution of outcome types varies only with m and (...) n and is necessary to the calculation of the expected utilities of successive ballots cast, in the same election, by a voter under a variant of approval voting. This variant allows the voter to cast several complete ballots provided that he pays the respective prices, which could reasonably be based on the expected utilities. The paper describes a shortcut method of calculating the distribution of outcome types when m=;4 andn rises to levels that make straightforward calculation computationally infeasible. The shortcut involves the combining of an outcome type, instead of each member of that type, with each of the 14 strategies available to the incremental voter. In going fromn-1 to n, for n=3, the number of outcome types increases by a factor of (n+3)/n whereas, the number of combinations of strategies increases by a factor of 14. (shrink)

The case of Helga Wanglie involved a conflict between the medical team, which concluded that a respirator was providing no medical benefit to the 87-year-old woman and should therefore be discontinued, and Ms. Wanglie's family who did not want the respirator removed. Most published commentary on the case has analyzed the medical team's conclusion. In contrast, this article examines the impact of the conflict on the conduct of the clinical case, and on the relationships among the various parties involved.

With the publication of this volume, a long dark age, or at least an age of (...) frustrations, comes to an end for English-speaking students of Kant's third Critique. To be sure, translations of the Kritik der Urteilskraft into English have long been available, but hitherto none has been quite satisfactory. J.H. Bernard's (1892) contained numerous errors. James Creed Meredith's (1911-1928) was too free for scholarly purposes. Werner Pluhar's (1987), though systematic in its treatment of Kant's vocabulary, imposed so much restructuring and rewording on his sentences as to make the translator himself an intrusive presence throughout.The new version by Paul Guyer and Eric Matthews surpasses its predecessors in almost every respect. (It equals Pluhar's in including the First Introduction.) In keeping with the principles of the Cambridge Edition of Kant's writings, the translators make literal accuracy a primary desideratum, and leave the work of interpretation, to the greatest extent possible, to the reader. The title itself reflects this policy. The consistent rendering of Urteilskraft as "power of judgment," rather than the familiar "judgment," makes it unambiguous when Kant is talking about judgments and when he is talking about the capacity to make them. It is to be hoped that this will discourage the misconstrual of Kant's distinction between (using Guyer and Matthews's terms) the [End Page 594] "reflecting" and the "determining" powers of judgment as a distinction between two varieties of judgments.The translators' practice of preserving the grammatical complexity of Kant's sentences does sometimes make one wish for some help with his pronouns, since English does not preserve the information that gender carries in German. In most cases, though, one gains more than one loses in comprehension of Kant's reasoning by having his sentences rendered whole rather than in pieces.There are occasions when what is presumably intended as literal accuracy seems more like a needlessly unbending attitude toward idiom. To take one example, at §19, Kant is translated as saying: "whoever declares something to be beautiful wishes [will] that everyone should [solle] approve the object in question and similarly declare it to be beautiful" (121). Of course, wollen is ordinarily to be translated as "want" or "will," and perhaps sometimes as "wish"; but it also can mean "claim" or "hold" in certain contexts, and this seems to me to be one of them, as all previous translators have taken it to be. (One can wish that others would do something, but one cannot intelligibly be said to wish that they should do something.)Of course, no translation can please everyone. Those who were attached to the jingle of "purposiveness without a purpose" may be disappointed to find Zweckmäßigkeit ohne Zweck rendered here as "purposiveness without an end." But, given that there is no good alternative to "purposiveness" to render Zweckmäßigkeit, and that Zweck figures so prominently in Kant's ethical thought, where it is always, and rightly, rendered as "end," the need for consistency and accuracy surely justifies the sacrifice of consonance. Zweck der Natur and Naturzweck are distinguished as "end of nature" and "natural end," respectively (apart from a lapse over pages 34-35); Endzweck and letztes Zweck as "final end" and "ultimate end"; streiten and disputieren (in the "Resolution of the Antinomy of Taste," §57) as "argue" and "dispute." In this last pair it seems to me that Bernard's and Pluhar's "quarrel" would have been a better choice for the first term. The distinction between Streiten and Disputieren, as between "quarreling" and "disputing," is certainly delicate, but not groundless; a distinction between "arguing" and "disputing" seems completely artificial. Much has been written by many distinguished persons about the philosophical, religious and ethical considerations of doctors and their involvement with torture. What follows will not have the erudition or authority of the likes of St Augustine, Mahatma Gandi, Schopenhauer or Thomas Paine. It represents the views of a very ordinary person; a presumption defended by the submission that many very ordinary persons have been, and will be, instruments for effecting, assisting or condoning the physical or mental anguish of others. (...) As practitioners of medicine, we are particularly vulnerable, since our particular knowledge and our privileged position may be so easily abused--to the detriment of others. Those of us who practice clinical forensic medicine have even greater responsibility by virtue of our daily contact with the enforcement of law, criminal procedure, and the machinations of the judiciary. We are thus particularly well placed to monitor, encourage or discourage the occurrence of evil practices within the community. It is imperative, therefore, that the ordinary doctor should be cognisant of, and be party to, a code of conduct formulated by his peers and having reference to his obligations as a citizen, and doctor, and to his ability to manipulate human activity. In Satire 3, Umbricius states his intention to leave Rome and delivers a long explanation of his decision, an explanation which develops into an invective against life in Rome. In the lines quoted above, Umbricius lists the ‘skills’ which are essential for success at Rome, ‘skills’ which he does not possess. The list comprises various mendacious, nefarious and criminal activities; Umbricius' stated inability to undertake such activities reinforces his claim to be a simple, honourable man . In this list is (...) his claim ‘I have never examined frogs’ entrails'. TLL glosses this passage ‘’ , the view taken by Friedländer too . Courtney takes a different view: ‘Presumably not for poisoning, which inspicere would hardly suit, but of divination … of an oriental type.’. (shrink)
